The real world isn't that exact. The judge will have been through the thought process - I reckon about a third of the blame lies with the family (presumably not supervising the kid, in short) and two thirds lies with the park (having unsecured high risk areas). Well 33.3% is a pain in the butt...
I think important detail there is that they did attribute 35% of the blame to the family too, so the net award was 'only' $5.3m. Sounds like a pretty horrendous accident nonetheless!

Such a shame to see Lightning Rod tumbling so far. That day/night back in 2016 will live forever as one of my "Top 10 coaster experiences" - sad to see the coaster is nothing like it's former self anymore.
Otherwise an excellent Top 30 there - can see the rationale behind each of those...
I went back in *checks notes* 2016(!!!) as work were paying for me to be in London already, and it was a chance to ride Olympia Looping (perhaps for the first time at Winter Wonderland...?).
Haven't felt any desire to go back since. Too expensive, busy and faffy for little gain for me.
It looks... fine? It doesn't seem to really do anything very interesting.
Hopefully with a bit more speed the forces will be alright, but doesn't feel hugely inspired.
Oh... I confess I haven't followed this it all - I just read "top spin Forbidden Valley" and assumed the rest.
That makes the decision slightly weirder, then. :D
I think the reality is - cost. They already have the plot, probably doesn't require much in the way of new foundations, could probably be easily pushed through a planning application/amendment as "replacing for something existing", it's a known entity to the park in terms of training and...
