I think that distinction is only because the tall coasters that are shuttle coasters tend to have the spike as the tallest point e.g. Superman at SFMM, Tower of Terror at Dreamworld.
While the structure is that tall, if you don't travel all the way to the top, whats the point for the rider...
Isn’t Funtime being held responsible for;
a) not showing up in court/not responding
b) it was found that if enough force was applied, their restraints could open up to an extra 3 inches which could have been a factor.

Also recommend to leave red force till later in the day. Everyone tends to flood Ferrari land as soon as it opens, then crowds drop significantly later in the day as it’s not a big enough park to retain the crowds that long!
